SLIP AND FALL / PREMISES LIABILITY

Meet attorney Alexey Savostyanov, California State Bar No. 363457. Russian-language consultation.

A premises liability claim requires evidence connecting the injury to negligent use or maintenance of property by a person or entity that owned, leased, occupied, or controlled it. Injury and causation also must be established. Civil Code § 1714 supplies the general duty of care; California jury instruction 1000 explains the basic elements.
The investigation may involve wet floors, uneven pavement, stairs, handrails, lighting, or debris. Depending on the condition and who created it, actual knowledge, how long it existed, and reasonable inspection practices may matter. Photographs of a hazard do not by themselves establish that a particular defendant negligently caused the injury.
If safe, document the condition, surrounding area, lighting, warning signs, and exact location. Keep witness contact details and identify people who observed the fall or the condition beforehand.
Report the incident and keep any report number. Tell the attorney about visible cameras so preservation can be requested promptly. A camera does not guarantee that usable footage exists or will be retained.
Keep medical records, bills, relevant footwear, and evidence of time missed from work. Explain the symptoms and limitations to your treating providers accurately.
For a store, apartment building, or other private property, identifying the owner, operator, tenant, and parties responsible for maintenance is an important early step. A sidewalk or other public-property claim may involve distinct statutory requirements and an earlier government claim deadline. The appearance of the property alone does not resolve who controls it.
The Westlake Village office serves injured clients in nearby Thousand Oaks and across California. During your consultation, explain where you fell, the condition involved, any report or witnesses, and your treatment. English and Russian consultations are available.
Other evidence may remain, including photographs, witnesses, incident reports, surveillance, maintenance records, and inspection records. Preserve what you have and discuss the missing evidence promptly.
No. Responsibility depends on control of the property, negligence, causation, and other facts, including any comparative fault.
The consultation is free. Fees and case costs for representation are explained in a written contingency fee agreement.
California’s general deadline for an injury or wrongful-death lawsuit is two years under Code of Civil Procedure § 335.1. Different rules and exceptions can apply, including to medical negligence and claims involving children. Claims against public entities generally require an earlier claim presentation, often within six months under Government Code § 911.2. Do not assume that negotiations with an insurer extend a deadline. A consultation should address the particular dates and defendants in your case.
